If a judge is determined by the Governor to qualify for a disability
benefit, he or she will continue to receive salary for one year,
however, not beyond age 70. After receiving salary for the year, a
disability benefit is payable from MSRS. The benefit is
based on length of service and high-five average salary. A judge
receives 3.2 percent for each year of service. The minimum
disability benefit is 25 percent of a judges high-five average
salary with no early-retirement deduction applied. At age 70,
a judge is considered retired, and no longer eligible for disability
or the one-year salary continuation.
